Misalnya dalam kitab Syafi&#8217;iyah:<\/p>\n<p>\ufed3\ufe88\ufee5 \u0627\ufeb3\ufe98\ufed4\ufe8e\ufebd \ufed3\ufef2 \u0627\ufedf\ufee8\ufe8e\ufeb1 \ufe83\ufee5 \ufed3\ufefc\ufee7\ufe8e \u0627\ufe91\ufee6 \ufed3\ufefc\ufee5\u060c \ufe83\ufeed \ufe83\ufee5 \ufed3\ufefc\ufee7\ufe8e \ufeeb\ufe8e\ufeb7\ufee4\ufef0 \ufe83\ufeed \ufe83\ufee3\ufeee\ufeef \ufe9f\ufe8e\ufeaf \ufe83\ufee5 \ufef3\ufeb8\ufeec\ufeaa \ufe91\ufeea\u060c \ufefb\ufee5 \ufeb3\ufe92\ufe90 \u0627\ufedf\ufee8\ufeb4\ufe90 \ufefb \ufef3\ufeaa\ufead\ufed9 \ufe91\ufe8e\ufedf\ufee4\ufeb8\ufe8e\ufeeb\ufeaa\ufe93<\/p>\n<p>Jika sudah tersebar di kalangan manusia bahwa Fulan adalah anaknya si Fulan, ataukah si Fulan adalah keturunan BANI HASYIM atau Umayyah, maka boleh menjadi saksi atasnya. Sebab nasab tidak diketahui dengan kesaksian (Al Majmuk, 20\/262)<\/p>\n<p>Beberapa tahun lalu ada seorang ustadz <a href=\"https:\/\/ulamanusantaracenter.com\/dua-perselisihan-ulama-salaf\/\">Salafi<\/a> yang mengatakan Sunan-sunan di Jawa tidak ada, mereka adalah tokoh fiktif. Alasannya karena para sunan tidak memiliki karya tulis! Aneh ini. Dari mana dan sejak kapan karya tulis menjadi persyaratan keberadaan seseorang?<\/p>\n<p>Rupanya cara berpikir tersebut tanpa terasa menjangkiti kita yang mempertanyakan keberadaan Sayid Ubaidillah bin Ahmad Al-Muhajir bin Isa. Alasannya tidak ada di kitab-kitab nasab terdahulu. Jawabannya, secara Fikih sudah sah.<\/p>\n<p><a href=\"https:\/\/id.wikipedia.org\/wiki\/Taqiyuddin_as-Subki\">Imam As-Subki<\/a> mengutip imam Mazhab kita:<\/p>\n<p>\ufed7\ufe8e\ufedd \u0627\ufedf\ufeb8\ufe8e\ufed3\ufecc\ufef2 \ufed7\ufe8e\ufedd \u0627\ufedf\ufee0\ufeea \ufecb\ufeb0 \ufeed\ufe9f\ufede {\ufeed\ufefb \ufe97\ufed8\ufed2 \ufee3\ufe8e \ufedf\ufef4\ufeb2 \ufedf\ufeda \ufe91\ufeea \ufecb\ufee0\ufee2}<\/p>\n<p>\ufeed\ufed7\ufe8e\ufedd \ufecb\ufeb0 \ufee3\ufee6 \ufed7\ufe8e\ufe8b\ufede {\ufe87\ufefb \ufee3\ufee6 \ufeb7\ufeec\ufeaa \ufe91\ufe8e\ufedf\ufea4\ufed6 \ufeed\ufeeb\ufee2 \ufef3\ufecc\ufee0\ufee4\ufeee\ufee5}<\/p>\n<p>Allah berfirman: &#8220;janganlah kamu mengikuti apa yang kamu tidak mempunyai pengetahuan tentangnya&#8221; (Al-Isra&#8217; 36). Dan Allah berfirman: &#8221; &#8230; akan tetapi (orang yang dapat memberi syafa&#8217;at ialah) orang yang mengakui yang hak (tauhid) dan mereka meyakini(nya).&#8221; (Zukhruf 86)<\/p>\n<p>Dari ayat ini Asy-Syafii berkata:<\/p>\n<p>\ufeed\u0627\ufedf\ufecc\ufee0\ufee2 \u0627\ufedf\ufeac\ufef1 \ufe97\ufe9c\ufe92\ufe96 \ufe91\ufeea \u0627\ufedf\ufeb8\ufeec\ufe8e\ufea9\ufe93 \ufee3\ufee6 \ufe9b\ufefc\ufe9b\ufe94 \ufe83\ufeed\ufe9f\ufeea \ufe83\ufea3\ufeaa\ufeeb\ufe8e \u0627\ufedf\ufeae\ufe85\ufef3\ufe94 \u0627\ufedf\ufee4\ufea0\ufeae\ufea9\ufe93 \ufeed\ufeeb\ufeee \ufe91\ufe84\ufee5 \ufeb7\ufeec\ufeaa \ufe91\ufe84\ufee7\ufeea \ufeb3\ufeae\ufed5 \ufe83\ufeed \ufeaf\ufee7\ufef0 \ufe83\ufeed \ufed3\ufecc\ufede<\/p>\n<p>Ilmu yang bisa dijadikan ketetapan dalam kesaksian ada 3. Pertama penglihatan semata, seperti menyaksikan pencurian, zina atau melakukan perbuatan.<\/p>\n<p>\ufeed\u0627\ufedf\ufe9c\ufe8e\ufee7\ufef2 \u0627\ufedf\ufeb4\ufee4\ufeca \u0627\ufedf\ufee4\ufea0\ufeae\ufea9 \ufeed\u0627\ufedf\ufe9c\ufe92\ufeee\ufe95 \ufed3\ufef2 \u0627\ufedf\ufed8\ufee0\ufe90 \ufeed\ufeeb\ufeee \ufe97\ufec8\ufe8e\ufeeb\ufeae \u0627\ufef7\ufea7\ufe92\ufe8e\ufead \ufe83\ufee5 \ufeaf\ufef3\ufeaa \ufe91\ufee6 \ufecb\ufe92\ufeaa \u0627\ufedf\ufee0\ufeea \ufeed\ufeb3\ufe8e\ufe8b\ufeae \u0627\ufef7\ufee7\ufeb4\ufe8e\ufe8f<\/p>\n<p>Kedua, pendengaran semata dan ketetapan dalam hati. Yaitu kabar yang tampak jelas sekali, seperti Zaid adalah putra Abdullah dan nasab-nasab lainnya (Thabaqat Asy-Syafiiyah Al-Kubra, 5\/224)<\/p>\n<p><strong>Oleh: KH.
